1. HOW MEMORY LANE WORKS
Step 1 — Your Memory Journal
Once your Bespoke Package has been booked and the 25% deposit has been paid, you will receive access to our online Memory Journal.
This is where you tell us your story. You can include memories, people, places, important dates, funny moments, special occasions, personal messages, photographs and any other information you would like us to understand.
Step 2 — Your Consultation
Once your Memory Journal has been completed, we will arrange a Zoom or WhatsApp consultation with you.
This gives us the opportunity to discuss your memories, clarify any information that may require further explanation and ensure that we understand your creative vision before production begins.
Step 3 — Creation
We will then create your bespoke song and/or video based on the information contained within your Memory Journal and discussed during your consultation.
The finished work is an original creative interpretation of your memories and is not intended to reproduce everything you have written word-for-word.
2. BESPOKE PACKAGES & STOCKED ITEMS
Memory Lane products are divided into two categories.
Bespoke Packages
Our Bespoke Packages are individually created for each customer and include:

Full Experience Package
The exact contents of each Bespoke Package will be confirmed in the customer’s quotation or package description.
Stocked Items
Stocked Items are products available to purchase individually and which do not require the bespoke creative production process.
These may include, but are not limited to:

Remastered photograph frames
-
Mugs
-
Placemats
-
Heart keyrings
-
CD copies
-
Other Memory Lane products offered for individual purchase
The products included within this category may change from time to time.
3. WHAT IS INCLUDED
Your quotation or selected package will confirm exactly what you have purchased.
Unless otherwise stated, a Bespoke Song commission includes:

Online Memory Journal
-
Zoom or WhatsApp consultation
-
Bespoke songwriting based on your memories
-
Music and vocal production
-
Production of the agreed song
-
One proof or sound bite for approval
-
One reasonable round of minor amendments
-
Final agreed digital recording
Video commissions will include the specific video deliverables stated in your quotation or selected package.
The Message in a Bottle and Full Experience Package will include the items and services specifically stated in the relevant package description or quotation.
Anything not specifically stated as being included is not automatically included.
4. PAYMENT
Bespoke Packages
For all Bespoke Packages, comprising the Bespoke Song, Message in a Bottle and Full Experience Package:
A 25% deposit is payable when the commission is booked.
The deposit secures the booking and allows Memory Lane to begin the agreed creative work.
The remaining 75% balance is payable after the initial proof or sound bite has been supplied and before the completed package is dispatched.
The completed physical package will not be dispatched until the outstanding balance has been received in full.
Where a Bespoke Package is supplied digitally rather than physically, the outstanding balance must be paid before final delivery of the completed work.
Stocked Items
All Stocked Items must be paid for in full at the time the order is placed.
Production, personalisation or fulfilment of a Stocked Item will not commence until full payment has been received.
5. CREATIVE INTERPRETATION
Memory Lane creates original creative work based on the memories, information and material supplied by the customer.
The final lyrics, melody, musical arrangement, vocal performance, production and creative presentation remain subject to our professional creative judgement.
We cannot guarantee that every individual memory, sentence, photograph, name or detail supplied will appear in the finished work.
By commissioning Memory Lane, you acknowledge and accept that the finished work is a creative interpretation rather than a literal transcription of the information supplied.
6. CHANGES & REVISIONS
Your Bespoke Package includes the revision allowance stated in your quotation or package description.
Where one revision round is included, this is intended for reasonable minor amendments to the agreed brief following receipt of the initial proof or sound bite.
The included revision does not cover:

A completely new song
-
A new musical concept
-
A complete rewrite
-
A substantial change of genre or musical direction
-
New lyrics throughout
-
A full re-recording
-
A significant change to the original brief
-
Repeated rounds of amendments
-
Additional video scenes
-
Major changes to an agreed video concept
Additional work may be charged separately.
No additional chargeable work will be undertaken without the customer’s agreement to the additional cost.
7. APPROVAL OF YOUR SONG
A proof or sound bite will be provided for your approval.
You are responsible for checking the proof carefully, including names, dates, lyrics and other factual information.
Once you have approved the final version, the commission will be considered complete from a creative approval perspective.
Any changes requested after final approval may incur additional charges.
8. CUSTOMER INFORMATION
You are responsible for ensuring that all information supplied to Memory Lane is accurate and complete.
This includes, but is not limited to:

Names
-
Dates
-
Places
-
Relationships
-
Quotations
-
Personal stories
-
Photographs
-
Videos
-
Recordings
Memory Lane cannot be held responsible for errors or inaccuracies resulting from incorrect, incomplete or unclear information supplied by the customer.
9. PHOTOGRAPHS, VIDEO & OTHER MATERIAL
Where you provide photographs, videos, recordings, lyrics or other material, you confirm that you have the necessary permission and rights for us to use that material for the purpose of producing your commission.
You retain responsibility for obtaining any necessary permission from other individuals whose photographs, recordings, videos or other material you provide.
You must not knowingly provide material that infringes another person’s copyright, privacy or other legal rights.
10. COPYRIGHT & RIGHTS TO THE FINISHED RECORDING
Unless otherwise agreed in writing, following full payment the customer will receive the agreed rights to use the finished sound recording/master recording created as part of the commission.
Unless expressly agreed otherwise in writing, rights in the underlying musical composition, including songwriting, lyrics, melody and publishing rights, are not transferred to the customer.
Our pre-existing intellectual property, production techniques, templates, software, processes, know-how and working materials remain our property.
Where ownership or licensing arrangements differ from those described above, the applicable rights will be confirmed separately in writing.
11. PROJECT FILES
Unless specifically included in the agreed package, the customer will receive the final agreed deliverable only.
Project files, DAW sessions, individual stems, MIDI files, prompts, production sessions, templates and other working files are not included unless expressly agreed in writing.
12. USE OF AI & THIRD-PARTY TECHNOLOGY
Memory Lane may use professional software, third-party platforms and artificial intelligence tools as part of the creative, songwriting, music production, editing or video production process.
The tools and technologies used are determined by us according to the requirements of the project.
The customer is purchasing the agreed finished creative work and not access to the software, platforms, prompts, models, production processes or working methods used to create it.
Where third-party technology is used, we will take reasonable care to use such technology appropriately and in accordance with the applicable terms of the relevant platform.
13. VIDEO COMMISSIONS
Video production is bespoke and forms part of the applicable Bespoke Package where stated in the quotation or package description.
Additional scenes, replacement footage, substantial changes to the agreed brief, significant editing requests or major changes after production has commenced may incur additional charges.
No additional chargeable work will be undertaken without the customer’s agreement to the additional cost.
14. PROOF, BALANCE PAYMENT & FINAL DELIVERY
Once the initial song proof or sound bite has been delivered, the customer will have 7 working days to review the proof and provide any amendments included within the agreed package.
The remaining 75% balance for a Bespoke Package must be paid in full before the completed package is dispatched.
If no response is received within 7 working days, the project may be placed on hold until the customer provides their instructions.
Following receipt of the customer’s final amendments or approval, and subject to receipt of the outstanding balance, we will aim to complete and dispatch the final Bespoke Package within 14 working days.
The 14-working-day completion period will only commence once we have received all relevant information, approvals, amendments and payment required from the customer.
Any additional changes requested outside the agreed revision allowance may require additional time and will be subject to an additional charge.
For these Terms & Conditions, “working days” means Monday to Friday, excluding UK public holidays.
15. CANCELLATION & REFUNDS
Memory Lane commissions are bespoke services created specifically for an individual customer.
Where the customer has a statutory right to cancel, those rights will apply in accordance with applicable UK consumer law.
For Bespoke Packages, where production or creative work has commenced following the customer’s request, the customer may be responsible for services already carried out and, where legally permitted, reasonable costs incurred up to the point of cancellation.
The 25% deposit is applied towards the customer’s Bespoke Package and is not intended to remove or restrict any statutory consumer cancellation or refund rights.
For Stocked Items, cancellation and refund rights will apply in accordance with applicable UK consumer law and the nature and stage of the order.
Nothing in these Terms & Conditions removes, restricts or limits any statutory consumer rights that cannot legally be excluded
Where a customer wishes to cancel an order or commission, they should contact Memory Lane as soon as possible.
16. CONFIDENTIALITY
We understand that your Memory Journal may contain private and personal information.
We will treat information provided to us as confidential and will not knowingly disclose your personal story to third parties except where it is necessary to provide the service, required by law, necessary for our professional services, necessary for technology platforms used to provide the service, or where you have given us permission to do so.
17. SHARING YOUR FINISHED SONG OR VIDEO
We will not knowingly use your personal story, photographs, finished song or finished video in our public marketing without your permission.
If you choose to provide permission for promotional use, that permission may be recorded separately.
18. RIGHT TO DECLINE A COMMISSION
We reserve the right to decline or terminate a commission where the requested material is unlawful, defamatory, threatening, abusive, discriminatory or otherwise inappropriate, or where completing the commission could create legal, copyright, safety or reputational concerns.
Where a commission is declined or terminated by us, any refund will be dealt with in accordance with applicable law and the circumstances of the individual commission.
19. CIRCUMSTANCES OUTSIDE OUR CONTROL
We cannot be held responsible for delays caused by circumstances outside our reasonable control.
This may include serious illness, technical failures, internet outages, software failures, third-party platform failures, power outages or other events beyond our reasonable control.
Where such circumstances occur, we will take reasonable steps to minimise any resulting delay and keep the customer informed where appropriate.
20. PERSONAL DATA
Information supplied through the Memory Journal, consultation and commissioning process will be used to provide and manage your Memory Lane commission.
Personal information will be handled in accordance with applicable UK data protection legislation and our Privacy Policy.
21. LIMITATION OF LIABILITY
We will take reasonable care in creating and delivering your commission.
To the extent permitted by law, we will not be responsible for indirect or consequential losses arising from the use of the finished work.
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability that cannot legally be excluded or limited.
22. GOVERNING LAW
These Terms & Conditions are governed by the laws of England and Wales.
This does not affect any mandatory consumer rights that may apply to you under applicable UK law.
23. ACCEPTANCE
By making payment for a Memory Lane Bespoke Package or placing an order for a Memory Lane Stocked Item, you confirm that you have read and accepted these Terms & Conditions.
For Bespoke Packages, you acknowledge that:

A 25% deposit is payable at the time of booking.

The remaining 75% balance is payable following receipt of the initial proof or sound bite.

The remaining balance must be paid before dispatch or final delivery.

The finished song or video is a creative interpretation of your memories.

Your selected package determines what is included.
-
You are responsible for checking the information supplied to us.

You are responsible for reviewing the proof or sound bite.

The included revision allowance is limited to the terms of your selected package.
-
Additional work or changes outside your agreed package may incur additional charges.
For Stocked Items, you acknowledge that:

Payment is required in full when the order is placed.

Production, personalisation or fulfilment will commence only after payment has been received.

The applicable cancellation and refund rights are subject to UK consumer law.
